Got job offer, accepted. Started job.Drug tested non neg due to RXs Was verified but still sent home – Legal?
I received a job offer and accepted, in writing, on 10-13-06. On 10-13-06 I gave my employer 2 week notice. I began my new job on 10-30-06 at 7:30am. At 8am they advised of drug testing requirement. I went home to get meds before test. I advised drug test facility I had meds that would test positive but they denied to look at the rxs. By the time I got back to work, my new employer had received a call that I had a non-negative reading and that it would be sent for further evaluation. I offered to get an additional test that would verify the drugs found in system. They approved. I got the test done, had it faxed over with a cover letter explaining my medical need and the type of medication prescribed and verified. The new employer still won’t let me work until they get results from Arizona lab and MRO. Is this legal? I was to START my job, now I’m WITHOUTa job and at a loss of income for appx 3 days. They could have done this 2 weeks ago.HR stated they can withdraw my offer!?

yup its legal. they can decide not to hire you based on just about anything. welcome to the overly paranoid 21st century. i would strongly advise being super nice to the hr people even though they are crappy cause they can do anything they want with your drug test. you might want to talk to the people that you interviewed with and hired you too just to keep them up to date on whats going on and express continued interest and not let hr act like a laison.

you can contract the civil liberty union and see what they have to say,but as far as i know a job does not have to have a reason for letting you go unless your in a union
Call a lawyer and sue if they don’t pay you for days off…..It is none of their business what prescribed medication you take as long as it doesn’t effect your job.

They are protecting other employees from a negligence lawsuit in the event the Arizona lab should find something non-Rx. They’re just protecting themselves, but it’s lousy I know.
The trouble is, depending on what meds you take and your medical condition, they may prefer you not work there and find cause during your probationary period.
Yes, they can withdraw their offer of employment. Some place you signed a paper that said something like "subject to satisfactory blah-blah-blah drug screening".
Best bet is to have a backup plan.
